Terms of Service
1. Acceptance of terms
By accessing the ApnaCloudy website or using our products and services, you agree to these terms. If you do not agree, do not use the services.
2. Our services
ApnaCloudy provides SaaS products (CloudyDeploy, CloudyMetrics), cloud engineering services, and consulting. Services delivered as projects are governed by a separate written agreement, which will prevail where it differs from these terms.
3. Accounts and acceptable use
- You must provide accurate account information and keep credentials secure.
- You may not resell our products without a written reseller agreement.
- You may not use the services to store or process unlawful material, or to breach others' rights.
- You are responsible for activity under your account.
4. Subscription plans and payments
Product pricing is published on our pricing page. Paid plans are billed in advance on a monthly or annual cycle and renew automatically unless cancelled before the renewal date. Fees are non-refundable except where required by law. A 14-day free trial is available on Business plans; you will not be charged unless you convert.
5. Intellectual property
We retain rights to our products, website, and brand. We grant you a limited, non-exclusive licence to use our products as described in your plan. For custom development projects, all commissioned code, designs, and documentation transfer to you upon payment, and we reserve a licence to reuse general-purpose components.
6. Availability and disclaimers
We aim for 99.9% uptime on paid product plans (measured monthly, excluding scheduled maintenance and events beyond our control). The services are provided "as is" without warranties beyond those stated here, to the fullest extent permitted by law.
7. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising from your use of the services is limited to the amount you paid us in the three months before the claim. We are not liable for indirect, incidental, or consequential damages.
8. Termination
You may stop using a product at any time; cancellation takes effect at the end of the current billing period. We may suspend accounts for breach of these terms, with notice where practical. You may export your data during the notice period.
9. Changes to these terms
We may update these terms with 30 days' notice by email or in-product announcement. Continued use after that constitutes acceptance.
10. Governing law
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Gurugram, Haryana, India.
